Access and use of the website www.museoscienza.org
is subject to the following conditions

Notice

These conditions apply to the entire content of the website under the domain www.museoscienza.org and to all forms of correspondence between the Museum and users, including newsletters or publications taken from the website or sent by the Museum.
The service that the website www.museoscienza.org offers users (hereinafter also referred to as the “User”) is provided by the Foundation of the National Museum of Science and Technology "Leonardo da Vinci" (hereinafter also referred to as “the Foundation” with head office in Via San Vittore 21, Milan according to the following General Conditions for the use of the website.
The Museum reserves the right to change at any time and without forewarning the General Conditions for the use of the website. The User may check at any time the valid text of the General Conditions as it is updated by the Museum on each separate occasion.
The Museum reserves the right to change or suspend all or some of the contents of the website at any time, including the availability of any service, database or content without prior notice.

Rules of conduct for the user

All of the content, whether text, graphics or other content appearing in this website is the property of the Foundation and in some cases the property of third parties with whom the Foundation has specific agreements. The User undertakes not to reproduce, duplicate, copy, sell, carry out framing*, resell and in any case not to exploit for commercial and/or publicity purposes the content of this website or any part of it, as well as the use or access to the site.

The User undertakes not to use the Service:

To upload, publish, send by e-mail or in any other way broadcast or distribute Content that is illegal, damaging, menacing, abusive, harassing, defamatory and/or slanderous, vulgar, obscene, damaging to others’ privacy, racist, classist or in any way reprehensible;
To cause damage in any way to minors;
To falsify his or her own identity by presenting himself, for example, as a representative of the Foundation, a forum leader, a guide or a guest, or to lie in any way about his or her relationship with other parties;
To create headings or in any other way manipulate distinctive signs or indications so as to counterfeit the origin of a Content broadcasted or distributed through the Service; To upload, publish, send by e-mail or in any other way broadcast or distribute Content which (s)he does not have the right to broadcast or distribute under the provisions of a law, a contract or due to a relationship of trust (for example classified information, confidential information learnt as part of a working relationship or protected by a confidentiality agreement);
To carry out framing activities on the content of the Service;
To upload, publish, send by e-mail or in any other way broadcast or distribute Content which involves the violation of patients, brands, secrets, copyright or other industrial and/or intellectual property rights of third parties (“Rights”);
To upload, publish, send by e-mail or in any other way broadcast or distribute advertisements, promotional materials, "junk mail**", "spam***", “chain letters”, pyramids or any other form of unauthorised or unrequested appeal;
To upload, publish, send by e-mail or in any other way broadcast or distribute any material containing viruses or other codes, files or programs created in order to interrupt, destroy or limit the functioning of the software, hardware or telecommunications systems of third parties;
To interfere or interrupt the Service, the servers or the networks connected with the Service, act against any requirement, procedure or rule of the networks connected with the Service;
To violate, intentionally or otherwise, any applicable law or regulation;
To pursue or in any other way harass third parties;
To create a database (electronic or otherwise) including material downloaded or obtained in another way from the site, without written authorisation from the Foundation; In a way such as to remove the copyright or the inscription(s) of the registered brand of any material in compliance with these terms;
In any way that could damage the reputation of the Foundation.

* Framing refers to the technique of including an external site, or a section of it, within an HTML frame layout so that the content is issued directly from the external site which is being cannibalised. In this way the other sections of the frame layout can be used to issue different content owned by the portal carrying out the framing.

** Junk mail refers to unrequested e-mail messages sent for advertising or other purposes.

*** Spam refers to the irritating transmission of the same message (publicity or chain letters) to a large number of users at the same time, by e-mail or via newsgroups.

Public Content on the Site

Pursuant to the General Conditions of use, all those areas to which access is allowed without limitation to the majority of people are considered “areas of the Site accessible to the public”. By way of example, the area on the online exhibitions of the Cimeli project is an area of the Site that is accessible to the public. With regard to Content that the User adds to the areas accessible to the public or which consist of photographs, images or other graphics files which the User decides to add to the exhibitions “with paper and scissors”, the User grants the Foundation the universally valid, free and non-exclusive consent to reproduce, modify, adapt and publicise said Content on the Site, for the sole purpose of visualising the content that has been included.

The Foundation reserves the right to refuse access to the site or to any part of it at any time and for any reason without giving prior notice.

The Foundation reserves at any time and for any reason the right to remove from the site material that has been posted, uploaded or sent in any way without giving prior notice.

General terms of use

Links
- The Foundation allows the site to be linked to other sites. Permission is not required to create a link to the site.
  However, the Foundation reserves the right to request the removal of a link from any web page considered not in line with the purposes of the Foundation.
- In order to respect the integrity of the contents of the site www.museoscienza.org and prevent confusion among internet users regarding the origin of the aforesaid contents, the following are forbidden:
  - Automatically inserted links (inline linking) which allow the internet user to automatically see contents from the site www.museoscienza.org or its affiliated sites in a specific space
  - Frame links (framing) which allow a page from the site www.museoscienza.org or its affiliated sites in a frame placed within a page of the site visited by the internet user.
- The following are permitted:
  - Simple links with the homepage of the site www.museoscienza.org or the home pages of other affiliated sites;
  - In any case, links are not permitted from sites that go against common decency, are violent, pornographic or paedophilic, which do not respect personal dignity or are aimed at displaying or selling objects, substances and/or illegal or illicit works.
  - The existence of a hypertext link from a third-party site and directed to the site www.museoscienza.org or other affiliated sites in no way implies a partnership between the Foundation and said third-party site. The Foundation has no control over the sites of third-parties and therefore takes no responsibility regarding the contents, products, services, information, materials or software of sites which include a hypertext link to the site www.museoscienza.org or other affiliated sites.
Intellectual property rights
- The Foundation may, at its sole discretion, publish any material that is submitted, sent by post, uploaded, sent by e-mail or transmitted in other ways to it or to the website and has the right to make additions to or remove content from any material before publishing it.
- The User grants the Foundation a non-exclusive license at global level, perpetual and free from rights, for the publication of any material submitted, uploaded, mailed, sent by e-mail or transmitted in any other way to the Foundation or to the site in any format including (without limitation) prints and electronic format.
Brands, logotypes
- The User undertakes not to use in any way the registered brands of the Foundation without the prior consent of the latter.

Security

Security violations of the system or of the network are forbidden and could be subject to criminal and/or civil proceedings. The Foundation may investigate incidents regarding said violations and could involve and cooperate with the police force if it suspects a criminal violation.

Personal data

The Foundation respects the privacy of its online visitors and undertakes to protect the privacy and safety of the users of its site. The privacy policy contains information on how the Foundation protects the User’s personal information. You are therefore invited to read the privacy policy carefully. This policy may be changed from time to time to adapt it to various questions and to changes in the site. All changes shall be published here. The Foundation undertakes not to sell, trade or communicate email addresses to companies or other organisations. No identifiable personal information regarding the User (such as name and surname, address, phone number or e-mail address) will be intentionally divulged to third parties without prior authorisation. The Foundation may ask for the User’s personal information in relation to his or her use or participation in competitions, lotteries, games, surveys, subscriptions, chats and notice boards. However, the Foundation will gather this personal information only if it is voluntarily given by the User.

Any personal information given to the Foundation may be used only in relation to the aforementioned activities. Should the User write e-mails to the Foundation with questions or comments, their personal information could be used in order to reply to said e-mails. Comments and questions may also be kept for future reference.

The User undertakes to supply the personal information (“Registration Data”) requested during the registration process, ensuring that this information is up-to-date, complete and truthful; to update promptly and continuously the Registration Data so that it is always up-to-date, complete and truthful. If the User supplies information that is false, inaccurate, outdated or incomplete, or if the Foundation believes, on the basis of its own discretionary assessment, that the information supplied is false, inaccurate, outdated or incomplete, the Foundation will in any case have the right to suspend, temporarily or definitively, the account of the User in question and to prevent him or her from using the site in any way subsequently.

With this, the User agrees that the Registration Data (and all updates to the Registration Data) and any other information sent to the Foundation from the User or in any other way obtained by the Foundation and regarding the User (Personal Data) could be used by the Foundation for the purposes of:

Processing requests from the User;
Supplying information to the User by e-mail or any other way;
Supplying information to the User regarding the products and services of the Foundation and of third parties;
Supplying a personalised service;
maintaining accounts and registrations;
statistical analysis and market research;
verifying and assessing how the site is being used;
compiling and administrating information and data bases.

The data controller is the Foundation. The complete list of data supervisors and of independent third-party data controllers connected to the work carried out by the Foundation can be consulted easily and free of charge by contacting the Foundation.

Article 7 of the Code on Personal Data Protection gives the User the possibility to exercise specific rights, including those of obtaining from the data controller confirmation of whether or not one’s personal data exists, and to have it made available in any intelligible form; to gain knowledge of the origin of the data, as well as of the logic and purpose on which the processing is based; to obtain the deletion, transformation to an anonymous form or block of data processed in violation of the law, as well as the updating, correction or addition to the data if so required; to opposite the data processing for legitimate reasons, or in other words oppose at any time data processing for the purposes of marketing and commercial information [the text of article 7 states: …processing of data regarding him for the purposes of sending advertising material or direct sales or for carrying out market research]. In order to exercise said rights the User may apply directly to the Foundation.

Cookies may be used on the site.

A cookie is a piece of information consisting of a string of text, which a website sends to the cookie file of the web browser program on the hard disk of the User’s computer so that the website can remember the user. A cookie contains the name of the domain which it comes from, its “lifetime” and a value, which is usually a single number generated at random.
When the User visits the site a cookie may be sent to him/her. Cookies can be used in the following ways:

· to help the Foundation to recognise the User as a unique visitor (simply a number) when (s)he returns to the site and to allow it to package content or information that take into account the interest of the User and to avoid the same information being shown to him/her repeatedly
· to compile anonymous overall statistics which allow the Foundation to understand how Users use the site and to help it to improve the structure of the site (this type of operation does not identify the User personally).

Two kinds of cookie may be used on the site, temporary cookies, which remain in the cookie file of the User’s browser until the site is left, and permanent cookies, which remain in the cookie file of the User’s browser for much longer (the length of time depends on the lifetime of the specific cookie). The User has the option of accepting or refusing cookies by changing the settings of his/her browser. In some cases it may not be possible to use all of the interactive features of the site if cookies are disabled. The site uses cookies to gather information on its Users and the data gathered in this way could be used in the same way in which the other data given to the Foundation is used (as set forth above) and for the same purposes.

The Foundation is concerned about the security and privacy of its users and, specifically, of minors. For this reason, an adult User who intends to allow his or her children under the age of 14 to access the services on the site undertakes to help them to create their account and to monitor their access to said services.

Special notice for international use

Considering the global nature of Internet, the User undertakes to respect all the local regulations concerning online conduct and contents. The User undertakes to respect all applicable laws concerning the transmission of data and content exported from the country in which said user is resident.

Indemnity clause

The User declares and guarantees to hold harmless and release the Foundation as well as the parties connected to it or controlled by it, its representatives, employees and any of its partners from any compensatory obligation, including reasonable legal expenses, which may derive from the Contents transmitted or sent by the User, by the User’s use of the Service, by the User connecting to the Service, a violation of the rules regulating its use, a violation of the rights of third parties.

Absence of guarantees from the Foundation

The User recognises and expressly declares that:

The use of the Site takes place at his or her sole and exclusive discretion. The Site is gradually supplied “AS IS” and “AS AVAILABLE” and therefore the Foundation accepts no responsibility regarding its use or availability, punctuality, or the deletion, failure to deliver or record any communication or personalisation of the User. Any guarantee on the Foundation’s part, whether explicit and/or implicit, is expressly excluded, including by way of example any guarantee of saleability, suitability for specific purposes or with regard to the quality of the service.
The Foundation does not guarantee
1. that the Site will satisfy the User’s requirements,
2. that the Site will be supplied without interruptions, punctually, securely or without errors,
3. the User’s expectations that the results obtained by using the Site are truthful or reliable,
4. that the quality of the products, services, information or other material acquired or obtained through the Site can satisfy the User’s needs, nor that
5. that any errors in the Software will be rectified.
Any Content downloaded or otherwise obtained by or through the Site is obtained at the sole and exclusive discretion and the exclusive risk of the User and that the User is the sole and exclusive responsible party for any damage to his/her own computer or for the loss of data caused by having downloaded said material or by having used the Site.
No notice, advice, consultancy or information, whether written or oral, supplied to the User by the Foundation or obtained from or through the Site, shall imply any guarantee which is not expressly established by these General Conditions for the use of the Site.
While every effort has been made to ensure that the site is free from viruses, the Foundation does not guarantee the certainty of this, and the User is required to ensure that adequate antivirus software has been installed. The Foundation is not responsible for any virus, computer code or any file or program transmitted with or as part of the Site, which interrupts, diminishes, destroys, limits the functionality or which compromises the integrity of any computer software or hardware or of any telecommunication tool or other material.

Applicable law and court of jurisdiction

These General Conditions and relations between the Foundation and the User are regulated by the law of the Italian Republic. For any controversy inherent, deriving from or in any way connected to these General Conditions for the use of the Site or connected to the use of the Site, the Court of Milan shall have sole jurisdiction.

Miscellaneous

These General Conditions are the sole and exclusive agreement between the User and the Foundation and they regulate the use of the Site, overruling any agreement previously made between the User and the Foundation. Furthermore, the User must follow any General Conditions on the use of complementary services or services related to third party content or to the rules of use of third party software. The Foundation’s failure to exercise a right it has by law or under these General Conditions does not in any case imply its waiver of said right. Should one or more provisions of these General Conditions be declared invalid by the competent judge, the parties agree that the judge must in any case seek to maintain the effectiveness of the agreements between the parties, as specified in this agreement and the other General Conditions shall remain fully valid and effective to all effects. The titles of the articles of the General Conditions have the sole purpose of facilitating the reading of said General Conditions and are of no juridical or practical consequence.

Acceptance of the general conditions for use of the site

The User declares pursuant to article 1341, paragraph 2, Italian Civil Code, that he or she has carefully read and specifically approves the terms contained in the sections above relating to:
